1. Category 4: Impure Water in Stagnant Water Bodies

Source text وَالرَّابِعُ: مَاءٌ نَجِسٌ وَهُوَ الَّذِي حَلَّتْ فِيهِ نَجَاسَةٌ وَكَانَ رَاكِدًا قَلِيلًا • Definition of Impure Water: Water in which any physical filth (Najasah, like a drop of urine, blood, or wine) falls, provided that the water is small and stagnant (Rakidun Qalilun). • Definition of Small Water Body: In Hanafi jurisprudence, any stagnant body of water that measures less than ten by ten cubits (duna 'ashrin fi 'ashrin). • The Ruling: If a small stagnant body of water comes into contact with even a minute drop of filth, the water becomes immediately impure (Najis) and invalid for purification, even if none of its physical qualities (taste, color, or smell) change!

2. Flowing Waters and the Role of Perceivable Effects

Source text أَوْ جَارِيًا وَظَهَرَ فِيهِ أَثَرُهَا، وَالْأَثَرُ: طَعْمٌ أَوْ لَوْنٌ أَوْ رِيحٌ • Large or Flowing Water: Water that is naturally flowing (such as rivers or canals) or is a large stagnant body of water (measuring 10 by 10 cubits or more). • Standard of Invalidation: Large or flowing bodies of water do not become impure merely upon contact with filth. They are legally classified as impure ONLY if a perceivable effect (athar) of the filth appears in them. • The Qualities of the Effect (al-Athar): Sourced from the matn, the effect is defined by three physical attributes: ◦ Ta'm: Change in taste. ◦ Lawn: Change in color. ◦ Rih: Change in smell.

3. Certainty of Filth & Introduction to Doubtful Water

Source text وَالْخَامِسُ: مَاءٌ مَشْكُوكٌ فِي طَهُورِيَّتِهِ وَهُوَ مَا شَرِبَتْ مِنْهُ الْهِرَّةُ... (شَرِبَ مِنْهُ حِمَارٌ أَوْ بَغْلٌ) • Certainty of Filth: The commentary footnotes clarify that water is ruled impure only upon certainty of filth falling or a dominant assumption (ghalabat al-zhann). Whispers, doubts, or baseless paranoia must be legally disregarded. • Category 5 (Doubtful Water - Ma' al-Mashkuk): Water from which a donkey or a mule has drunk. • This water is physically clean (it is not impure or filthy), but its legal capacity to remove ritual impurity is classified as doubtful under sacred law.

4. Combining Wudu and Tayammum for Doubtful Water

• The Legal Process: If the time of prayer enters and a person find no water available except Doubtful Water, they must perform a combined process: ◦ Perform Wudu with this doubtful water. ◦ Perform Tayammum with pure earth. • Performing Prayer: Having completed both acts, they perform their prayer, which is then legally valid and accepted. • The Sequence: According to the commentary, while both must be done, it is highly recommended and preferred (al-Afdhal) to perform Wudu first and then perform Tayammum: "wal-Afdhalu taqdim al-ma'...".

5. Juristic Debates & Lineage Rules of Mules

• Mule Motherhood Rule: The commentary footnotes specify that a mule's leftover water is only doubtful if its mother was a female donkey (atan), not a mare (ramkah). • The Legal Reason: Sourced from the footnote: "wal-'Ibratu lil-Umm" — because in animal leftover rulings, the mother determines the juristic lineage and status of the animal's leftovers. • The commentary reports Abu al-Tahir al-Dabbas's objection to calling the ruling itself doubtful and specifies the relevant mule as one whose mother is a female donkey.
