1. The Eight Validity Conditions of Dry Ablution (Tayammum)
Source text يَصِحُّ بِشُرُوطٍ ثَمَانِيَةٍ... • Tayammum (Linguistically): To aim, intend, or target. • Tayammum (Legally): Purifying oneself using clean earth in a specific manner when water is unavailable or unusable due to a valid excuse. • Core Principle: Dry ablution serves as a legal substitute for both minor ablution (Wudu) and major bath (Ghusl). • Hanafi law establishes eight conditions of validity for Tayammum, without which the purification is void. The most prominent are intention and a valid excuse.
2. Condition 1: The Intention and Its Strict Timing
Source text الْأَوَّلُ: النِّيَّةُ... وَوَقْتُهَا عِنْدَ ضَرْبِ يَدِهِ عَلَى مَا يَتَيَمَّمُ بِهِ • Timing of Intention: The intention (Niyyah) must be present at the exact moment of striking the hands on the earth. • While intention is a Sunnah in Wudu, it is a strict condition of validity in Tayammum because earth is not inherently purifying like water. • Three Valid Intents: The intention must include one of the following to be valid: ◦ Intending to remove states of ritual impurity (Hadath). ◦ Intending the permissibility of prayer (Istibahat al-Salah). ◦ Intending a distinct act of worship that is invalid without purity (such as the Funeral prayer or Sajdah al-Tilawah).
3. Condition 2: Valid Excuses (Distance & Sickness)
Source text الثَّانِي: الْعُذْرُ الْمُبِيحُ لِلتَّيَمُّمِ كَبُعْدِهِ مِيلًا عَنْ مَاءٍ... وَحُصُولِ مَرَضٍ • Islamic law permits earth purification only under genuine, legally certified difficulties. The valid excuses include: • Distance: Water is at least one mile (approx. 1.6 km) away from the resident or traveler. ◦ If water is closer than one mile and there are no barriers, Tayammum is legally invalid. • Sickness: A well-founded fear (based on prior experience or expert medical advice) that using water will cause an illness, increase its severity, or delay the recovery of a wound.
4. Excuses Part 2 (Freezing Cold, Enemy Danger, & Thirst)
Source text وَبَرْدٍ يَخَافُ مِنْهُ التَّلَفَ... وَخَوْفِ عَدُوٍّ وَعَطَشٍ • The remaining valid excuses that permit Tayammum: • Extreme Cold: Freezing conditions where performing ablution/bath threatens life or limb, and absolutely no means of warming the water exists. • Fear of an Enemy or Beast: The proximity of a dangerous enemy, thief, or wild beast near the water source, threatening life, property, or safety. • Scarcity and Thirst: Having water present but in limited volume, reserved strictly for the immediate or future drinking needs of humans or livestock.
5. Excuses Part 3 (Funeral & Eid Prayers vs. Daily Prayers)
Source text وَخَوْفِ فَوْتِ صَلَاةِ جَنَازَةٍ أَوْ عِيدٍ... • Fear of Missing Funeral Prayers: If a person arrives when the Funeral prayer (Janazah) is about to begin, and knows that performing Wudu will result in missing the prayer completely (which has no makeup): ◦ The Ruling: They are permitted to perform Tayammum immediately and join the prayer. • Fear of Missing Eid Prayers: Missing the Eid prayers due to the time required for Wudu also permits Tayammum because Eid has no individual makeup. • The Daily Obligatory Prayers: If a standard daily prayer (like Zuhr or Asr) is ending, performing Tayammum to catch the time is NOT allowed. Wudu must be made, and the missed prayer must be completed as makeup (Qada').
6. Condition 3: Pure Earth Genus (Jins al-Ard)
Source text التَّيَمُّمُ بِطَاهِرٍ مِنْ جِنْسِ الْأَرْضِ كَالتُّرَابِ وَالْحَجَرِ وَالرَّمْلِ • The Genus Rule: Tayammum is valid only with materials that are pure and belong to the genus of the earth (Jins al-Ard). • Permissible Materials: ◦ Soil (Turab), sand (Raml), stone (Hajar), or raw unglazed clay bricks. ◦ It is not required for these items to have loose dust on them; striking a clean, dust-free solid stone is fully valid. • Invalid Materials: Materials that melt in fire or burn to ashes do not belong to the genus of the earth: ◦ Wood (Hatab), gold (Dhahab), silver (Fiddah), copper, or cloth. Tayammum is invalid on them (unless they are heavily covered in thick, loose soil/dust).
