1. What Is Juristic Disagreement?

Juristic disagreement occurs when qualified jurists reach different conclusions while studying a Fiqh question through scholarship. Recognized juristic disagreement belongs to qualified scholarship; not every unsupported or personal opinion becomes a recognized disagreement.

For example, two qualified scholars may hold different reasoned scholarly views on the same Fiqh question. That is not a personal quarrel.

2. Two Reasons: Reports and Understanding

Sometimes a relevant report may have reached one jurist but not another, or qualified scholars may understand a text's wording, meaning, or context differently. The scholarly material available to them, or their understanding of it, may therefore differ.

Such a difference may have a scholarly basis, so disagreement alone does not prove hostility or carelessness.

3. Reconciliation and Juristic Method

Sometimes qualified scholars differ in how they understand related scholarly material together and reconcile it. Differences in recognized juristic method can also lead to different Fiqh conclusions.

In simple terms, reconciliation means considering related scholarly material together and understanding the place of each part. Qualified scholars may differ in how they do this.

4. Manners of Disagreement

When discussing a disagreement, attribute a view accurately to the relevant scholar or Madhhab, respect qualified scholars, and avoid mockery or contempt.

If different fatwas appear in a real religious question, a beginner does not choose a view merely by personal preference; the learner seeks guidance from qualified scholars. Respect also does not make every unsupported claim valid.
