1. Menstruation: Juristic Definition and Nature
Source text بَابُ الْحَيْضِ وَالنِّفَاسِ وَالِاسْتِحَاضَةِ: الْحَيْضُ هُوَ دَمٌ يَنْفِضُهُ رَحِمُ بَالِغَةٍ... • Al-Hayd (Linguistically): Flowing or running (of any liquid). • Legal Definition: The blood discharged from the uterus of a mature female who is neither pregnant (Habl) nor suffering from an illness (Da'). • Conditions: ◦ The female must be physically mature (pubescent). ◦ She must not be pregnant. ◦ She must not have reached menopause (Iyas). ◦ The discharge must not be caused by any internal injury, trauma, or disease.
2. Minimum and Maximum Durations of Menses
Source text وَأَقَلُّ الْحَيْضِ ثَلَاثَةُ أَيَّامٍ وَلَيَالِيهَا، وَأَوْسَطُهُ خَمْسَةٌ، وَأَكْثَرُهُ عَشَرَةٌ • The Hanafi school defines three distinct duration levels for menstruation: ◦ Minimum Duration (Aqall): Three days and three nights (strictly 72 hours). If bleeding stops even a single minute short of 72 hours, it is legally chronic bleeding (Istihadah), not menses. ◦ Average Duration (Awsat): Five days. ◦ Maximum Duration (Akthar): Ten days and ten nights (strictly 240 hours). Any bleeding that continues beyond the 10-day limit is classified as chronic bleeding (Istihadah).
3. The Interval of Purity between Menses
Source text وَأَقَلُّ الطُّهْرِ الْفَاصِلِ بَيْنَ الْحَيْضَتَيْنِ خَمْسَةَ عَشَرَ يَوْمًا • Al-Tuhr al-Fasil: The interval of physical purity (free of blood) separating two menstruations. • Minimum Limit: The minimum purity interval between two menses is fifteen (15) days. ◦ If a woman's menses ends, and she experiences fresh bleeding before fifteen complete days of purity have passed, this new discharge is classified as chronic bleeding (Istihadah), not a new menses. • Maximum Limit: There is no maximum limit for the purity interval. A woman may remain pure without bleeding for months, years, or indefinitely.
4. Legal Prohibitions Part 1: Salah & Fasting
Source text وَيَحْرُمُ بِالْحَيْضِ وَالنِّفَاسِ ثَمَانِيَةُ أَشْيَاءَ: الصَّلَاةُ وَالصَّوْمُ... • There are eight specific actions strictly prohibited during menstruation and post-natal bleeding: ◦ Performing Salah: Prayer is strictly prohibited. ◦ Fasting (Sawm): Fasting is strictly prohibited. • Prayers missed during menstruation do not require makeup, while missed fasts must be made up.
5. Legal Prohibitions Part 2: Mosque, Quran, & Tawaf
Source text ...وَدُخُولُ مَسْجِدٍ، وَالطَّوَافُ، وَقِرَاءَةُ الْآيَةِ، وَمَسُّهُ... • The subsequent prohibited actions are: ◦ Entering a Mosque: Entering the physical prayer hall of a mosque is prohibited (except under absolute, forced necessity). ◦ Tawaf: Circumambulating the Ka'bah is prohibited. ◦ Reciting the Quran: Verbally reciting even a single verse of the Quran (whether looking or from memory) is prohibited. ◦ Touching the Quran: Touching the physical copy of the Quran or any printed verse without a separate, detached protective cover is prohibited.
6. Legal Prohibitions Part 3: Marital Intimacy Limits
Source text ...وَالْجِمَاعُ، وَالِاسْتِمْتَاعُ بِمَا تَحْتَ السُّرَّةِ إِلَى الرُّكْبَةِ • The final two prohibited actions govern marital intimacy: ◦ Intercourse (Jima'): Actual sexual intercourse is strictly prohibited. ◦ Enjoying the Navel-to-Knee Area: Direct skin-to-skin contact or taking pleasure from the woman's body between the navel and the knee (ma bayna al-surrah wa al-rukbah) without a separating, thick fabric barrier is prohibited. ◦ Permitted Intimacy: Taking pleasure from above the navel or below the knee is fully valid without dislike, and sleeping in the same bed and eating together are allowed by consensus.
