1. The Witr Prayer: Legal Status and Structure

الْوِتْرُ وَاجِبٌ، وَهُوَ ثَلَاثُ رَكَعَاتٍ بِتَسْلِيمَةٍ • Juristic Status: In the Hanafi school, the Witr prayer is classified as Wajib (necessary/mandatory), which is close in obligation and status to a Fard prayer. ◦ Intentionally omitting Witr is sinful, and performing its make-up (Qada') is legally required. • Structure: Witr consists of three rak'ahs performed continuously, ending with a single Salaam (Taslimah) at the very end. ◦ Performing Witr by separating the units with a Salaam after the second rak'ah (as practiced in other schools) is legally invalid in Hanafi Fiqh.

2. Recitation Requirements & The First Sitting

وَيَقْرَأُ فِي كُلِّ رَكْعَةٍ مِنْهُ الْفَاتِحَةَ وَسُورَةً، وَيَجْلِسُ عَلَى رَأْسِ الْأُولَيْنِ وَيَقْتَصِرُ عَلَى التَّشَهُّدِ • Recitation Rule: It is necessary (Wajib) to recite Surah al-Fatihah followed by an appended Surah (or three short verses) in all three rak'ahs of Witr. ◦ (Note that in Fard prayers, appending a Surah is only Wajib in the first two units). • Al-Qa'dah al-Ula (First Sitting): Sitting after completing the second rak'ah is necessary (Wajib). ◦ Limitation: The worshipper must restrict themselves to reciting only the Tashahhud in this sitting, and must stand up for the third unit without adding the Salawat/blessings.

3. The Qunut Supplication and Takbir

فَإِذَا فَرَغَ مِنَ الْقِرَاءَةِ فِيهَا رَفَعَ يَدَيْهِ حِذَاءَ أُذُنَيْهِ ثُمَّ كَبَّرَ ثُمَّ قَنَتَ قَائِمًا قَبْلَ الرُّكُوعِ فِي جَمِيعِ السَّنَةِ • Takbir of Qunut: In the third rak'ah, after completing the recitation of Fatihah and the Surah, and before bowing, the worshipper raises their hands to the earlobes and says "Allahu Akbar". • Timing of Qunut: After clasping the hands again, the worshipper recites the Qunut supplication while standing before bowing (Qunut qabl al-Ruku'). • Year-Round Rule: The act of Qunut is necessary (Wajib) throughout the year and is not restricted to Ramadan. • Phrasing: The Sunnah supplication "Allahumma inna nasta'inuka..." may be recited; one who has not memorized it may recite "Rabbana atina..." The Wajib is the act of Qunut, not one uniquely mandatory formula.

4. Forgetting the Qunut & Congregational Witr

وَيُصَلِّي بِجَمَاعَةٍ فِي رَمَضَانَ فَقَطْ، وَلَا يَقْنُتُ فِي غَيْرِ الْوِتْرِ • Omission of Qunut: If a worshipper forgetfully omits the Qunut supplication in the third rak'ah and proceeds to bowing (Ruku'): ◦ They must not recite the Qunut during bowing or after standing up from it. ◦ They are legally required to perform Sujud al-Sahw at the end of the prayer to rectify the omission. • Congregational Witr: Performing Witr in congregation is legally legislated only during the month of Ramadan. ◦ Throughout the rest of the year, Witr must be performed individually. • Except for the Qunut of distress (Qunut al-Nazilah), reciting Qunut in other daily prayers is not legislated in the Hanafi school.
