• The Rule: If a living creature falls into a well and dies, but the carcass has not swollen or disintegrated: • The Ruling: Complete drainage is not required. Instead, the law prescribes draining a specific number of buckets based on the animal's physical volume. • We will study the precise obligatory bucket numbers for small and medium animals.

Source text وَإِنْ مَاتَ فِيهَا فَأْرَةٌ أَوْ نَحْوُهَا لَزِمَ نَزْحُ عِشْرِينَ دَلْوًا إِلَى ثَلَاثِينَ • The Scenario: If a small animal dies inside a small well and is removed before swelling: • Example: A mouse (Fā'rah), a sparrow, or a small lizard. • Bucket Requirements: ◦ Wajib (20 buckets): Legally obligatory to drain. ◦ Mustahabb (30 buckets): Highly recommended to drain. • The additional ten buckets are recommended to clear any lingering doubts or misgivings about the well's purity.
3. Medium Animal Death (Chicken, Cat)
Source text وَإِنْ مَاتَ فِيهَا دَجَاجَةٌ أَوْ هِرَّةٌ أَوْ نَحْوُهُمَا لَزِمَ نَزْحُ أَرْبَعِينَ دَلْوًا إِلَى سِتِّينَ • The Scenario: If a medium-sized animal dies inside the well and is removed before swelling: • Example: A domestic cat (Hirrah), a chicken (Dajājah), a pigeon, or a similar animal. • Bucket Requirements: ◦ Wajib (40 buckets): Legally obligatory to drain. ◦ Mustahabb (60 buckets): Highly recommended to drain. • After draining these buckets, the well is legally pure and its water is valid for Wudu.
4. Creatures That Do Not Contaminate Well Water
Source text لَا تَنْجُسُ الْبِئْرُ بِمَوْتِ مَا لَا دَمَ لَهُ فِيهِ كَسَمَكٍ وَضِفْدَعٍ وَبَقٍّ وَعَقْرَبٍ • General Exceptions: Well water is NOT contaminated by the death of the following creatures: ◦ Creatures with no flowing blood: Flies, mosquitoes (Baqq), scorpions ('Aqrab), hornets, and spiders. ◦ Water-born creatures: Fish (Samak), water frogs (Difda'), and crabs. ◦ Live falls: Any human or halal animal that falls in and is extracted alive, provided there is no physical impurity on its body and its mouth did not touch the water.
5. Tolerated Amounts of Droppings and Dung
Source text وَلَا تَنْجُسُ الْبِئْرُ بِالْبَعْرِ وَالرَّوْثِ وَالْخَثْيِ إِلَّا أَنْ يَسْتَكْثِرَهُ النَّاظِرُ • Concession of Public Necessity ('Umūm al-Balwā): Islamic law tolerates minor falling of animal droppings into well water: • Tolerated Items: Camel or cow dung (Rawth / Khibā'), sheep or goat dung (Ba'r), and horse dung. • The Condition: These items do not contaminate the water unless the volume is so large that it is considered excessive (Yastakthirahu al-Nāthir) in the eyes of an average viewer. • This legal ease exists because in rural areas, it is practically impossible to completely shield open wells from livestock droppings.
6. Unknown Death Timing: Non-Swollen
Source text وَوُجُودُ حَيَوَانٍ مَيِّتٍ فِيهَا يَنْجُسُهَا مِنْ يَوْمٍ وَلَيْلَةٍ إِذَا لَمْ يَنْتَفِخْ • The Scenario: If a dead animal (like a mouse) is found in the well, and nobody knows when it fell and died, but the carcass has not swollen or decayed: • The Legal Ruling: The well water is declared impure starting from one day and one night (24 hours) prior to its discovery. • Legal Consequence: Any Wudu made using this water during this 24-hour period is ruled invalid. All prayers performed during this duration must be repeated, and any clothes washed with it must be re-washed.
7. Unknown Death Timing: Swollen
Source text وَإِنْ تَنَفَّخَ أَوْ تَفَسَّخَ فَمِنْ ثَلَاثَةِ أَيَّامٍ وَلَيَالِيهَا • The Scenario: If the dead animal discovered is swollen or disintegrated/decayed, and its time of falling and death is completely unknown: • The Legal Ruling: The well water is declared impure starting from three days and three nights (72 hours) prior to its discovery. • Legal Consequence: Any Wudu performed using this water during these 72 hours is invalid, and all prayers performed during this period must be repeated.
